TERMS AND CONDITIONS

These terms and conditions (“Terms”) govern your participation in the fitness retreats organised by Mana Performance Collective Pty Ltd (“Mana Performance,” “we,” “us,” or “our”). By booking a retreat or participating in any activities organised by Mana Performance, you agree to be bound by these Terms. If you do not agree with these Terms, you may not participate in the retreat.

1. PAYMENT POLICY

a. To reserve a spot on a specified retreat, a non-refundable booking fee of $250 AUD is required upon booking to secure the reservation. Full payment (the balance) must be made within 30 days of the retreat start date. Prices are based per person, twin share (share with another retreat guest or bring a friend/partner) or for private rooms where specified, but DO NOT include flights. Participants must have adequate travel insurance to cover all activities listed.

2. TRAVEL INSURANCE

a. Please note, even if you have private health insurance in Australia or your respective country of residence, it is unlikely that this insurance will cover overseas trips such as the retreats offered by Mana Performance. It is your responsibility to organise suitable travel insurance. Although we strongly encourage you to do so, you acknowledge that Mana Performance is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially, or otherwise.

3. HEALTH AND MEDICAL DISCLAIMER

a. Participants are responsible for ensuring they are in suitable physical condition to participate in retreat activities. By attending the retreat, you acknowledge that you have consulted a physician about your ability to engage in fitness or wellness activities, particularly if you have any pre-existing medical conditions. Mana Performance Collective Pty Ltd will not be liable for any injuries, illnesses, or medical conditions that may arise during the retreat.

4. MANA PERFORMANCE CANCELLATIONS DEFINITIONS

a. “Cancellation” is defined as not attending your scheduled retreat, including postponing or rescheduling. “You” refers to the guest booking a Mana Performance retreat. “We” refers to Mana Performance Collective Pty Ltd. It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of cancelling or postponing their retreat, but unexpected things do happen, so please consider purchasing travel cancellation insurance.

5. TRAVEL CANCELLATION INSURANCE

a. Depending on the policy and conditions, travel cancellation insurance may pay for some or all cancellation fees. Strictly for informational purposes and not to be relied upon, with most agencies, this type of insurance must be purchased within 14 days of making your reservation to optimise your level of protection.

6. GUEST CANCELLATION POLICY

a. Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule (“the Cancellation fee schedule”):

• If you cancel 180 days or more before your retreat start date, you will be refunded (less any bank or exchange fees) 25% of the full retreat amount (minus your $250 booking

• If you cancel less than180 days before your retreat start date, you will be refunded (less any bank or exchange fees) 50% of the full retreat amount (minus your $250 booking 

• If you cancel 90 days or less before your retreat start date, you will forfeit your entire payment.

b. Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason. We do not offer credit for arriving late or leaving early. A guest can change to another of our retreats 30 days or more before your retreat start date for a fee of $250. Please note the retreat must have availability.

7. MANA PERFORMANCE COLLECTIVE PTY LTD CANCELLATION POLICY

a. If Mana Performance Collective Pty Ltd must cancel a retreat for any reason, you’re entitled to transfer your full retreat payment to another retreat (either scheduled or at some future time). Alternatively, you may request a refund of your applicable payment, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your retreat. Mana Performance Collective Pty Ltd is not responsible for your expenses incurred in preparation for any cancelled retreat, such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip. If an event is postponed due to circumstances outside of our control, you will be provided with your choice of a place on the new event date or a 100% credit voucher to use on any of our retreats.

8. ITINERARY CHANGES DUE TO WEATHER OR OTHER UNFORESEEN CIRCUMSTANCES

a. Mana Performance Collective Pty Ltd reserves the right to modify or adjust the retreat itinerary due to weather conditions, safety concerns, or any unforeseen circumstances beyond our control. This includes, but is not limited to, changes in scheduled activities, day trips, or workshop timings. In such cases, we will make every effort to provide comparable alternatives. While we understand that such changes may be disappointing, no refunds or credits will be issued for modifications resulting from circumstances outside our control.

b. We advise all participants to remain flexible and understanding of the fact that retreat activities and schedules may need to adapt for the safety and comfort of all guests. Mana Performance will communicate any changes as early as possible and will ensure that the overall retreat experience remains fulfilling and aligned with the intended goals of the retreat.

9. COVID-19 OR HEALTH-RELATED TRAVEL RESTRICTIONS

a. Participants are responsible for complying with all health and travel guidelines, including any restrictions related to COVID-19, at both their departure and destination points. Mana Performance Collective Pty Ltd is not responsible for any costs, disruptions, or cancellations due to changes in travel restrictions, quarantine requirements, or other public health mandates.

10. PASSPORTS, VISAS & DOCUMENTS

a. It is the responsibility of each participant to obtain a valid passport, visa(s), and necessary certificates for any country to be visited in connection with a Mana Performance Collective Pty Ltd retreat. Passports must not expire within 6 months of your retreat dates.

11. THIRD PARTIES

a. Mana Performance Collective Pty Ltd holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a retreat as compared with the advertised nature of the service.

12. INDEMNIFICATION

a. By participating in the retreat, you agree to indemnify and hold harmless Mana Performance Collective Pty Ltd, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims demands, liabilities, damages, losses, costs, and expenses (including but not limited to reasonable attorneys’ fees) arising out of or in connection with your participation in the retreat, including but not limited to any injury, illness, loss, or damage to person or property. This indemnification shall extend to any third-party claims, actions, or proceedings brought against Mana Performance Collective Pty Ltd arising from your actions or omissions during the retreat.

13. GENERAL WAIVER

a. You acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat organisers, and insofar as legally permissible, surrender your right to any cause of action against Mana Performance Collective Pty Ltd arising from any loss or damage to person or property that occurs during a retreat.

14. LIABILITY FOR PERSONAL PROPERTY

a. Mana Performance Collective Pty Ltd is not responsible for any loss, theft, or damage to personal property during the retreat. We recommend all participants secure their belongings and take out appropriate insurance if needed.

15. WELLNESS PROGRAM PARTICIPATION WAIVER

a. You acknowledge that participating in fitness classes, workshops, and other physical activities carries inherent risks. By signing up for the retreat, you agree to voluntarily participate and assume all risks related to these activities. Mana Performance Collective Pty Ltd will not be responsible for any injuries or adverse health outcomes resulting from participation.

16. DIETARY RESTRICTIONS AND ALLERGIES

a. Participants are responsible for informing Mana Performance Collective Pty Ltd of any dietary restrictions or allergies prior to the retreat. While we strive to accommodate dietary preferences, we cannot guarantee the absence of allergens in the meals provided. Participants with severe allergies are advised to take necessary precautions.

17. EMERGENCY AND EVACUATION PROCEDURES

a. In the event of an emergency requiring evacuation or emergency medical care, participants acknowledge that such situations may incur additional costs that are not included in the retreat package. Mana Performance Collective Pty Ltd will assist in coordinating emergency responses but is not responsible for these expenses.

18. PHOTO/VIDEO RELEASE FORM

a. By booking into a retreat, you consent to the use of photographic portraits, images, and videos in which you feature, taken during the course of the retreat, for commercial use in association with Mana Performance Collective Pty Ltd’s business. You hereby release and discharge Mana Performance Collective Pty Ltd from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any claims for libel or invasion of privacy.

19. SEVERABILITY

a. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these terms and conditions, and the remaining provisions shall continue in full force and effect to the fullest extent permitted by law. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision of these terms and conditions.

20. CHANGES TO TERMS AND CONDITIONS

a. Mana Performance Collective Pty Ltd reserves the right to change or update these terms and conditions at any time without prior notice. By continuing to participate in any retreat or services provided by Mana Performance, you agree to be bound by the most recent version of these terms and conditions.

All credits and vouchers are not redeemable for cash or refund.
